User Agreement
Description of terms of use for www.ozbid.com.au.
Terms and conditions in this Agreement describe the provisions for use of our services www.ozbid.com.au (website) and the principles of our affiliates.
By reading and agreeing with, you the user accept all of the terms and conditions in this agreement, which include those terms and conditions expressly set out below, before becoming a member of Ozbid Online Auctions.
This agreement is effective from the time of registration including all new registered users, and is otherwise effective from the 26th of December 2007 for all users.
I. Membership Eligibility.
Services provided on this website [www.ozbid.com.au] may only be used by an individual/s that can legally enter into contracts applicable to state and federal law within Australia. It is not permissible for persons less than 18 years of age or members that have been notified of temporary and or indefinite suspension. Sellers applicable to this website must be verified before posting or listing items for sale. Only accredited and verified providers (sellers) are eligible to list or sell items on the Ozbid website and at no time is an un-verified member of the public eligible to list or sell or on-sell.
II. Fees and Services.
Membership and bidding / buying or purchasing on the Ozbid website are not applicable to any charges or fees. Selling, Classified, and or Store Fronts including the withdrawal from sale of an item or listing prior to a completed sale are all included under the applicable fees or charges listed under the fees section of the Ozbid website. Fees and charges are applicable to change with notification posted 14 days prior to any changes but are limited to new listings posted after the expiration of this notification period. All fees and charges are listed in Australian Dollars [Aud$] therefore it is the individuals obligation to assume responsibility if trading in another monetary currency [not Australian Dollars] for the conversion rate of that currency to Australian Dollars. The currency converter on the Ozbid website is only for the purpose of approximate calculations and no guarantee of its accuracy is provided.
III. Bums on Beds trading as www.ozbid.com.au is not an Auctioneer.
With reference to the Bums on Beds on-line auction website (www.ozbid.com.au), we clearly state that Ozbid Online Auctions and the website is not an auctioneer. Ozbid Online Auctions and the website is only provided as an internet tool for verified providers to sell at anytime, from anywhere, in a variety of formats, including a fixed price format and an auction-style format commonly referred to as an "online auction". Bums on Beds trading as www.ozbid.com.au have no interest or interaction between a seller & buyer. Bums on Beds trading as www.ozbid.com.au offer no guarantee for the content, condition, pricing and availability of the listings for sale on the website. Bums on Beds trading as www.ozbid.com.au offers no involvement in transactions between buyers and sellers, if a dispute between users occurs, you accept and acknowledge that Bums on Beds trading as www.ozbid.com.au (staff/employees, partners and or its owners) are released from litigation directly and indirectly of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
IV. Information Control.
Bums on Beds trading as www.ozbid.com.au only provides communication directly related to the invoicing of listing fees, notification of listing and notification of sale or not sold. Bums on Beds trading as www.ozbid.com.au offer no endorsement, guarantee or legitimacy of your transactions. The Seller or Buyer in all cases is solely responsible for communication between the seller and buyer concerning the status of a sale and the information or interaction of information between the seller and buyer. Bums on Beds trading as www.ozbid.com.au offers no endorsement or guarantee of information added to the original site content by a user and Bums on Beds trading as www.ozbid.com.au advises that although all sellers are verified there is no guarantee for the content provided by a user. It is the seller’s responsibility to adhere to all applicable state and federal laws and you agree that Bums on Beds trading as www.ozbid.com.au is released from any legal involvement if there is a conflict of interest with these or other governing laws.
V. Fraud.
It is the sole discretion of Bums on Beds trading as www.ozbid.com.au to remove or cancel membership of any user that acts, advertises or conducts fraudulent sales or information on the Ozbid website.
VI. Manipulation.
It is against the agreed terms and conditions of the Bums on Beds trading as www.ozbid.com.au website to alter, manipulate or force or change the price of a sale through fraudulent means and that the user or users will be terminated from membership without notification. It is agreed that a user (Seller) will not post contact details including Website addresses, Email Addresses, Phone Numbers, Postal Addresses & or ant other means of contact through the content of the users/Sellers advertising within the Ozbid website. It is agreed that all contact between a Seller & Buyer (users) will be completed through the Ozbid website's internal Seller/ Buyer (user) email contact.
Verified Members (Sellers) agree that within reasonable or stated time periods on invoicing documents (Emails) that all fees and charges issued by Bums on Beds trading as www.ozbid.com.au are finalised in full by the required date (the fifteenth of each month) of that payment. Payments of fees & charges can be made by the following process.
1) PayPal deposit
2) Bank Cheque
3) Money Order
4) Direct Bank deposit
All verified Members (Sellers) agree that if payment of fees & charges are not made within the required time period of 14-days from the date of invoice it is at the sole disgression of Bums on Beds trading as www.ozbid.com.au to suspend that Verified Members (Sellers) account until such time as those fees & charges are paid in full.
